US Judge Mandates Freedom of Abrego Garcia from Immigration Detention

A federal judge has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, finding his continued confinement lacks lawful basis.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.

The case stems from a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an error. Following his repatriation to the United States to face alien smuggling allegations, he was held in immigration custody.

In her order, the court pointed out that the authorities does not have a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."

The legal proceedings center on disputed claims. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this claim.

He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing trial in Tennessee.

The court, who was overseeing his petition to deportation in a federal court, ruled that he must now comply with the terms of his release from custody in Tennessee. This decision shifts his monitoring to the Tennessee court.
